1.5 Activity and System Data

When you use the platform, we may automatically gather information about your device, operating system, IP address, device ID, browsing history, and usage data. This is also collected via cookies (see Section 7).

1.6 Visitor Data

When visitors to websites created and hosted through the Merlin Platform submit information through lead-generation forms or similar data-collection features, or interact with such websites, we may collect that information ("Website Visitor Data"). This may include the visitor's name, email address, phone number, any other information submitted through the form, and usage data such as clicks, page views, and browsing behavior.

1.7 Geo Location

We may process your device geo-location, subject to your consent as required by applicable law.

1.8 Job Applications

If you apply for a job, we collect your name, contact details, resume, recommendations, and any other information you share, including data from third-party application services (e.g., LinkedIn).

2. How We Use Your Personal Data

2.1 General

We use the personal data we collect for the following purposes:

With respect to Website Visitor Data collected through Customer websites, Merlin processes such data as an independent controller (or 'business' under applicable privacy laws such as CCPA) for its own purposes, including product improvement, model improvement and training, analytics, and marketing. Merlin does not process Website Visitor Data as a service provider on the Customer's behalf for these purposes. Where a Customer has removed or materially modified their privacy notice that we provide to the Customer ("Standard Notice") on their website, Merlin will not process Website Visitor Data collected after such removal or modification through that website for Merlin's independent purposes described above.

2.2 Analytics

We use analytics tools to collect and analyze usage information. This helps us identify trends and improve our services. We may use Google Analytics — learn more at Google's Partner Sites page.

3. Sharing the Personal Data We Collect

3.1 Access-Holders

Various persons at the Company who need access to your personal data have such access. The identity and type of access-holders may change in accordance with business needs.

3.2 Affiliates

We share information with affiliated companies where necessary to provide products and services and for business management.

3.3 Service Providers and Subcontractors

We disclose information to trusted service providers to help provide the Services, aid their understanding of usage, and for direct marketing:

Merlin collects and processes personal data submitted by visitors to websites created and hosted through the Merlin Platform ("Website Visitor Data"), including information submitted through lead-generation forms and similar data-collection features.

For this processing, Merlin acts as an independent data controller and not as a processor or service provider on behalf of the website owner. Merlin uses Website Visitor Data for its own purposes, including product improvement, model improvement and training, analytics, and marketing.

A Standard Notice is displayed on Customer websites to inform visitors of this data use. If a website owner removes or modifies the Standard Notice, after such time, Merlin will not use Website Visitor Data collected through that website for Merlin's independent purposes.

10. Communications

We may send you service-related communications without offering an opt-out. If you don't wish to receive them, you may cancel your account.

11. Children

We do not knowingly collect personal data from children under 18. If you become aware that a minor has enrolled without parental permission, please advise us immediately.

12. Access to Content after Death

Where permitted by law, you may leave instructions on how your account should be handled after your death. A legally authorized person may request access to, copies of, deletion of, or closure of your account. Contact us at help@hey-merlin.com with proof of authority.
